it-economics GmbH End-User License Agreement

IMPORTANT PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENCE AGREEMENT CAREFULLY BEFORE CONTINUING WITH THIS PROGRAM INSTALL

It-economics End-User License Agreement ("EULA") is a legal agreement between you and it-economics for the products, plugins, add-ons, blueprints and all therein contained material of it-economics which may include associated software components, media, printed materials, and "online" or electronic documentation. By installing, copying, or otherwise using our products (it-economics software), you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the program between you and it-economics, (referred to as "licensor"), and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use it-economics software.
Our product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The it-economics software (which consists of itself and of all its containing parts and documentation, even online) are licensed, not sold. It-economics may modify this Agreement from time to time.
By installing this software, you agree to it-economics GmbH’s privacy policy. If you do not agree, you are not allowed to use this software in any type or form.

    all software and products, plugins, add-ons, blueprints and all therein contained material of it-economics which may include associated software components, media, printed materials, and "online" or electronic documentation
  • Atlassian:
    Australian company and operator of the Atlassian Marketplace, where it-economics software can be licensed. Level 6, 341 George St Sydney, NSW, 2000, Australia

1. Rights of Use

Techradar is owned by it-economics GmbH. It-economics GmbH is the solitary owner of any copyrights, trademark rights and patent rights of the software. The software is not open source which means you may not modify or access its source code in any kind.

2. Terms

This Agreement is only applicable if you have our software installed. It will terminate if you uninstall Techradar.

3. Description of other rights and limitations

(a) Maintenance of Copyright Notices.

You must not remove or alter any copyright notices on any and all copies of the it-economics software.

(b) Prohibition on Reverse Engineering, Decompilation, and Disassembly.

You may not reverse engineer, decompile, or disassemble the it-economics software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

(c) Rental.

You may not rent, lease, or lend the it-economics software.

(d) Compliance with Atlassian EULA when the license is acquired through the Atlassian Marketplace.

4. Termination

Without prejudice to any other rights, the licensor may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the it-economics software in your possession.

All title, including but not limited to copyrights, in and to the it-economics software and any copies thereof are owned by it-economics or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the it-economics software is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved for it-economics.

6. no warranties

The licensor expressly disclaims any warranty for the it-economics software. The it-economics software is provided 'As Is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, non-infringement, or fitness of a particular purpose. The licensor does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the it-economics software or within the online documentation. The licensor makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. The licensor further expressly disclaims any warranty or representation to Authorised Users or to any third party.

7. limitation of liability

In no event shall the licensor be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of 'Authorised Users' use of or inability to use the it-economics software, even if the licensor has been advised of the possibility of such damages. In no event will the licensor be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. The licensor shall have no liability with respect to the content of the it-economics software or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights, or the disclosure of confidential information. Due to German law “Vorsatz” (deliberate act) “grobe Fahrlässigkeit” (culpable negligence) as well as violation of life, body or health cannot be excluded, therefore the licensor is liable for Vorsatz and grobe Fahrlässigkeit as well for violation of life, body or health for German licensees.

By accepting this agreement, you acknowledge that the software may not be free from defects.

8. Support

Techradar is unsupported, which means there won't be any guaranteed support. If you have any problems or questions you can contact us via Atlassian Marketplace.

9. Data

We don't have any access to your data once Techradar is installed in your system. We don't take liability if your data gets erased or stolen.

10. Law

The laws and the courts of Germany apply for this software. You may not use our software to break the law in any type or form. If you do so, our contract is terminated immediately and you must uninstall Techradar from all of your systems.
